What’s the law on abortions in Texas?
Robert Pittman Judge block the fetal heartbeat abortion law. Therefore, before we get the entire story let’s first check what the law says.
Despite the 1973 Supreme Court decision that defined an abortion right as a constitutional right and the Texas law prohibiting abortions after 6 weeks into pregnancy came into effect in September 20, 2021.
Texas legislators ratified lawmakers in the state approved Texas Heartbeat Act at the end of May in 2021. The law prohibits abortions once heart activity is detected. It can happen at least six weeks into pregnancy, or when a woman is aware that she’s carrying a child.
While the Act was contestable in court, no full hearing was held until September 2021. Now, the Robert Pittman judge ordered that the Act be suspended on the 6th of October, 2021.
The first Heartbeat Act thus allows court instances not only to go against abortion providers but also against abortion funding companies and employers that provide abortions. Additionally, anyone who violates the Act will be liable for an amount of at least $10,000 per abortion as well as attorney’s costs.
This makes it the most strict in the nation regarding access to abortion. Other states, including Georgia and Mississippi have also passed “heartbeat” laws that prohibit abortions once cardiac activity has been found. But, the legislation was halted due to legal challenges and is still to be enforced.
What is the most famous thing Robert Pittman Judge said?
Judge Pitman dismiss the Justice Department’s appeal against the state’s ban on abortion. He stated “Women are being unfairly prevented from exercising control in ways that are protected under the Constitution following the introduction of S.B. 8.”
He added that the restriction has already brought “irreparable harm” to those seeking abortions, and will continue to cause irreparable harm to those seeking abortions. On the 6th October 2021, federal judge Pitman temporarily lifted the most restricting abortion legislation in the nation.
End:
The battle to stop the ban, of course, isn’t over however. It’s just a first and a positive step in a time when women’s rights are being fought. In an announcement, Robert Pittman Judge stated, “We will continue to fight for constitutional rights against those who attempt to sabotage the rights of women.”
